268 Arrests For 29 Days May’s Record
More Than Half of Them Were for Violation of Traffic Laws
Sessions of the municipal court Saturday were characterized by the disposal of numerous cases, and jail commitments were meted out to three persons due to nonpayment of fines. Heavy dockets have been faced by the court each day during the last two weeks.
A total of 268 persons were arrested by police during the first 29 days of May, and of this number 154 were charged with violations of the traffic and nontraffic cases were heard by Magistrate Thomas Lenihan.

Grog Permits Not Part of Retail Stock
Liquor Licenses Found Separate From Fixtures

Helena, May 29 — Liquor licenses are not part of the “stock and fixtures” of a retail establishment, the supreme court ruled today.
By a 4-1 margin the court reversed a Wheatland county district court decision that Archie and Cecelia Zeiter should give up the retail beer and liquor licenses they retained when they lost possession of the Corral club near Harlowton for failure to keep up payments.
Chief Justice Hugh Adair held that Ed Light and five others, who sold the premises, were not entitled to a revision of the sales contract to include the licenses. He called attention to the fact that the contract did call for sale of 62 cases of liquor in a Billings warehouse despite the fact only one of the six held a license to sell liquor.
Adair quoted the Montana law which calls for fines and imprisonment up to $5,000 and 5 years for sales without a license and added:
“Should the Corral club bar be owned and operated by the six plaintiffs as partners, then the law requires the licenses must be issued to the partnership and must set forth the names of the persons conducting the business.”
The Zeiters and Herman and Alice Baehler bought the establishment and stock and fixtures in April, 1946. The Baehlers gave a quit claim deed to their interest in the contract after the initial default in payments. The Zeiters remained in control, however, until suit to remove them was started in 1948. Upon vacating, they took the licenses and offered to sell them to the partnership for $7,000.
Retail liquor licenses had no sales value in Montana until after the 1947 legislature set up a quota for each community based on population. Most communities already had more licenses than the quota provided but the law said existing license rights would not be disturbed.
Angstman Dissents
The $7,000 valuation fixed by the holders of the Harlowton club license appears to be at or near the minimum figure recognized in the business today. It was argued recently in another liquor case from Martin City that the license was worth $10,000. No litigation has developed to indicate what a license in more populous centers of the state would bring on the open market.
Associate Justice Albert Angstman dissented in today’s case. He asserted the majority opinion was based on matters not brought up in pleadings or in briefs filed by opposing counsel.
He pointed out that under this decision, and a recent Helena case in which it was held licenses are applicable only to the premises to which issued, present owners of the Corral club have an establishment but no license with which to conduct a legal business whereas the Zeiters have a license but not place in which to operate.

Cascade County 4-H Leaders Elect New Officers, Select Committees
Mrs. Vic Norris, Fort Shaw, was elected president of the Cascade County 4-H Leaders council at the group’s annual spring meeting here. She succeeds Frank Schrupp, Great Falls.
Other officers named were R.C. Johnson, Cascade, vice president; Mrs. Theodore Fosse, Great Falls, secretary, and Mrs. Mac Fetsko, Stockett, treasurer.
Council members took time out at noon from their all-day meeting to be guests of the Kiwanis club at a Hotel Rainbow luncheon. Colored slides on 4-H activities were shown by County Agent Ted Fosse.
The 4-H leaders were welcomed to the luncheon by Vice President Beecher Cushman. Mrs. Mildred Amdahl gave the response for the leaders. Beverly Schock played accordion selections, accompanied by Beverly Erdman. Both are from the Boston Heights 4-H club.
Dr. Gordon Reynolds, Missoula, president of the Montana district of Kiwanis, was a luncheon guest, speaking briefly.
In afternoon sessions at Hotel Rainbow five committees were named for the year. Demonstrations were given and a round table discussion was held on club problems. A film, “Growth of a Nation,” was shown.
Named to a North Montana State fair committee to plan arrangements for the fair were Mrs. R.C. Johnson, Cascade; Mrs. R.L. DuPay, Great Falls; Mrs. Ben McCoy, Belt; Lane Briggs, Manchester, and Stanley Warner, Eden route.
Special awards committee members are Mrs. E.C. Erickson, Stockett; Mrs. Amdahl, Black Eagle; Mrs. William McKay, Great Falls; Mrs. J.R. Zbinden, Fort Shaw, and Lloyd Smiley, Eden. The group will work with the county agent’s office in selecting most outstanding 4-H members for consideration for state awards.
Three committees were selected to arrange for the district leaders’ conference here Oct. 31-Nov. 1.
Members of the welcome and hostess committee are Mrs. Charles Jarrett, Mrs. Harlan Hansen and Mrs. Joe Cummings, all of Great Falls; Mrs. Victor Norris, Fort Shaw, and Mrs. Erick Erickson, Stockett.
R.C. Johnson, Cascade, and John Coulter, Great Falls, were appointed to arrange for car parking at the conference.

Eagles Auxiliary Elects Officers
Mrs. Esther Derrer was installed president of the Eagles auxiliary at a regular meeting Thursday evening at Eagles hall. Mrs. Frances Kimmerle was installing officer and Mrs. Lorraine Rothweiler was installing conductress.

Give Pointers
Mrs. Dora C. Smith, county home demonstration agent, gave pointers on modeling at a meeting of the Best in the West 4-H club Friday at the home of Mrs. Joseph Matteucci. Garments which will be shown at the North Montana State faair were modeled by Loretta Gerger, Mary Lou Matteucci, Margaret Kerkes, Diane Busike, Jo Ann Matteucci and Elizabeth Ann Kerkes. Plans for a picnic in the near future were discussed. Mrs. Matteucci and Mrs. Herman Baehler are leaders of the group.

Deaths and funerals.
Herman G. Baehler
Herman G. Baehler, 66, Lincoln, retired manager of the Beacon Sun River Inn, died Wednesday afternoon at a local hospital.
Born in Medford, Wis., he came to Montana in 1927 and lived in the Eden area until entering the U.S. Army in 1940. Baehler served with the 163rd Field Artillery in the Pacific theater. He was a member of the Veterans of Foreign Wars.
He married Alice V. Zeiter in 1946. For 11 years he worked for Carl Weissman and Sons, then took over management of the Beacon Sun River Inn, retiring in 1976. He had lived the past two years in Lincoln.
His wife survives with two daughters, Mrs. Robert (Karen) Gusdal, Lynnwood, Wash.; and Mrs. Ronnie (Kathy) Ford, Great Falls; a stepson, Andy Bobbett, and a stepdaughter, Barbara Loveland, both of Great Falls; 11 grandchildren; his brothers, Art and Walter Baehler, both of Great Falls, and William Baehler, Milwaukee, Wis.; and two sisters, Hilda Hess, Greenwood, Wis.; and Lydia Clemens, Medford, Wis.
Services will be Friday at 3 p.m. at Croxford and Son’s Mortuary. Burial will be in Highland Cemetery.
